Pretoria – “It is clear the South African government wants the 70 men (being held in Zimbabwe for an alleged coup attempt)to be extradited to Equatorial Guinea,” says the men’s attorney.

“It’s also clear the government doesn’t give a hoot if these men are sentenced to death or whatever happens to them,” said Alwyn Griebenow.

He was speaking on Wednesday after the government indicated it would oppose an application in Pretoria High Court to force the state to intervene on the men’s behalf.

Griebenow’s team gave the president’s office until Wednesday afternoon to respond to a request to either seek the men’s extradition to South Africa or ensure they were not tried in Equatorial Guinea.

The government had been asked also to ensure the men’s constitutional rights not to be tortured or treated inhumanely would be upheld in the other two countries.

Griebenow said he “cannot comprehend” the government’s reaction.

“We fly the Equatorial Guinea investigative team around in police helicopters, but advocate Jan Henning of the national prosecuting authority had said earlier the South African government did not dare become involved in that country’s handling of the case seeing as there was no chance of a free and fair trial.

“Now, the government is helping this team with taxpayers’ money while the fate of the 70 men apparently has been signed and sealed.”

According to Griebenow, he was told shortly before 16:00 about the government’s decision.

Presidential spokesperson Bheki Khumalo said: “The State attorneys have been instructed by the government to file a notice to oppose the application.”

He declined to discuss the merits of the matter.

Griebenow said: “The fact that the government opposes the application implies that it wants the opposite of what we are asking, to happen.”

No mention of a prima facie case against them

The counter argument against the team’s request is apparently that the South African government cannot force its constitutional clauses on another country’s government.

It has been said also that although the national prosecuting authority is investigating the men’s activities, there has been no mention of a prima facie case against them.

If the government request the extradition of the men to South Africa, it probably then would not be able to prove in court that the men did indeed transgress the stipulations of the act on international military aid.

The men could then be acquitted and consequently would be able to sue the South African government.
