Who Ordered Kalafati’s Execution

The Monitor is in possession of a letter in which the late John Kalafatis informed his lawyer claiming that his life was in danger.

Kalafatis was killed on Wednesday night. Family members and friends say they were warned in advance that the Office of the President (OP) had issued an order to kill him.

Kalafatis’s younger brother, Costa, said security agents confronted him on Wednesday and told him that they were going to kill his elder brother that day.

In his letter, Kalafatis said he was a target of security agents.

“They said I should be shot on sight. Now imagine what they can do to me if they can get their hands on me. So, I would like you to represent me so that there will be a handing over and that I should not be tortured as that is their intention. I have no pending case at court once the file is opened, I’ll give you a call at your office, I’d appreciate your acceptance and assistance,” Kalafatis said in his letter dated 4 March 2009.

In the letter to the lawyer, Kalafatis said he was wanted in connection with a house burglary that occurred in Phakalane on Christmas day.

“What I gather is that there were two intruders, one light in complexion and the other dark. I’m scared of going to them because the president has an influence in this matter. Apparently the complainant called the president to tell him that he was robbed at home, since they are family friends,” the letter said. Kalafatis said the complainant is a white businessman.

Kalafatis said the Directorate on Intelligence and Security (DIS) and the police suspected him of committing the offence. They also raided his home and told his younger brother that they wanted him in connection with the alleged offence. He said the police also arrested his younger brother. The young brother was also warned of what was to become of Kalafatis.

Kalafatis said his friend, Tshepo Mosala, was also arrested in connection with the case.

He said Mosala was put in an identification parade but it was called off because the wife of the complainant did not want to participate.

Kalafatis’s lawyer, Busang Manewe, confirmed that he told him two months ago, that he has been warned that there was an order out to kill him. The lawyer said two relatives and a friend also expressed similar concerns.

Manewe said he advised Kalafatis to hand himself over to the police. But he never anticipated that an order could be issued to kill someone. “I never thought this would ever happen in this country,” he said.

The lawyer said he got a rude awakening when he received a call that Kalafatis was shot by security agents.

Meanwhile, Kalafatis’s friend, Mosala revealed in an interview that a DIS agent whose name he revealed, told him that they have been given orders by the Office of the President to kill Kalafatis. “You can put it on record,” he said.

He claims that he was told that the president was the one who ordered the killing.

He alleges that he was told by the DIS agents that the wife of the complainant has relocated to the United States and has threatened that she would only come back when the people who committed the offence were killed.

He said the DIS agents later told him that they were no longer dealing with the case.

They told him that some Botswana Defence Force (BDF) commandos have been assigned the job of executing Kalafatis.

It did not come to him as a surprise when Kalafatis was killed on Wednesday because he knew there was such an order. Mosala said he also fears for his life. He said he knows of other people who are on a hit list.

Sources said Kalafatis was killed in cold blood in the back seat of a stationery car at Extension 12. According to sources, even after the shooting Kalafatis was left at the scene for a long time before his corpse was taken to the mortuary at Princess Marina Hospital. The police said Kalafatis was fatally shot by soldiers.

In an interview, the Permanent Secretary in the Ministry of Defence, Justice and Security, Augustine Makgonatsotlhe, said there was no such order made by the Office of the President to kill anyone. He said there are no extra judicial killings in the country.

“No directive of that nature can come from the government. I can assure you that the President cannot do that. The law cannot allow him to do that. We don’t kill people. We believe in the rule of law. We are a democratic society,” he said.

Makgonatsotlhe said if the president had issued such an order, he would be in a position to know. But he said this could never be allowed.
