They were all there and all – bar one – raped Jessica. This was the damning evidence presented in the Durban High Court on Wednesday against four young men accused of robbing Tim Foord and his daughter, Jessica, and gang-raping her near a dam at Hillcrest a year ago.
In the witness box before Judge Vivienne Niles-Duner was a 17-year-old (who cannot be named) who has already pleaded guilty to his role in the crimes and is serving 17 years in prison.
On Wednesday, he identified all four men sitting in the dock.
Mbotho Msomi, 26, Lindani Maphumulo, 19, and Ntuthuko Chili, 19, have all pleaded not guilty to charges of robbery with aggravating circumstances, sexual assault and rape.
Msomi says he was not there at all, Maphumulo says he left the area when the others planned the robbery, and Chili says he was forced to do what he did by Msomi.
The fourth accused, Siyabonga Ntinga, has admitted robbing the Foords but denies the rape and sexual assault charge.
The state is proceeding with all charges against him, alleging he acted in “common purpose” with the others for the sexual offences.
On Wednesday, they had to face the teenager who claims he was with them at the Polo Pony Dam on March 2 last year.
He testified they had gone there to fish when they saw the Foords playing with their dogs.
“Msomi went to (Tim Foord’s) bakkie and came back with a wallet and cellphone.
“We then went (towards the Foords) to rob them.”
He said they had knives and a gun, but he could not recall exactly who had what.
After robbing them of jewellery and cellphones, they had “thrown” the pair into a ditch, and tied Tim Foord to a tree.
He said they had all raped Jessica, except for Ntinga who was waiting in the bakkie.
The teenager claimed that he had been forced to rape Jessica by Msomi, who had been armed with a knife.
Under cross-examination, it was suggested to him that Msomi had not been present and he was falsely implicating him.
The teenager replied: “He is lying. He did it.”
He also denied suggestions that Ntinga was his cousin and that Maphumulo had left the dam before the robbery and rapes.
He remained adamant that Chili had raped Jessica, in spite of Tim Foord’s evidence that Chili had remained with him, guarding him while she was being raped.
“His (Foord’s) back was to us and he would only occasionally turn to see what was happening. Maybe he did not see,” the teenager said.
Jessica and her father have already testified, and it was expected that the State would close its case before the end of the week.
The accused would then be given an opportunity to testify and call witnesses.
