Trembling and holding back tears, the mother of 19-year-old waitress Vicky McLachlan – whose battered body was found nine days after she disappeared – told the Cape High Court her daughter “never deserved to die like that”.
Daphne McLachlan was painstakingly detailing her attempts to find her daughter after she failed to return home after a shift at the Diep River restaurant where she worked.
She was testifying in the trial in which Johannes Petersen, Jonathan Fortune and Mogammat Gaffoor are charged with robbery with aggravating circumstances, hijacking, indecent assault, rape, murder and the illegal possession of a firearm and ammunition.
They have pleaded not guilty.
A fourth accused, Rashaad Square, 29, entered into a plea bargain and is the State’s main witness. He was sentenced to an effective 22 years in jail.
Vicky McLachlan went missing on April 9, 2003 after dropping off a colleague in Heathfield at about 11.45pm. She had just finished her shift at the Tavern ‘n Ale pub in Diep River, where she had been working since August that year.
A huge hunt, involving 140 volunteers from the police and the SANDF, was launched soon after her disappearance. Her car was found two days later in Sea Winds, near Lavender Hill, a mere 5km from her home in Grosvenor Road, Diep River.
At the time of her disappearance, her family took out newspaper advertisements and also distributed pamphlets.
As part of the plea bargain, Square, a 28s gang member, told in a statement how he and his co-accused went to Fifth Avenue in Retreat to rob people.
On the corner of Fifth Avenue, the group saw Vicky McLachlan’s BMW approaching and Gaffoor ordered the rest to hide behind a church wall. McLachlan stopped nearby and dropped off a man. When she stopped at a stop street, an armed Gaffoor jumped in front of her car.
Gaffoor asked for money and pulled a gold chain from her neck.
They then drove to a deserted area in Philippi where they parked at a farm entrance.
“We pulled her out of the car by her hair and searched the car for valuable items.
“Gaffoor took her about three metres away from the car and indecently assaulted her before taking her to a compost heap and raping her. Fortune and I also raped her.
“Gaffoor said she must die because she saw our faces.
“Fortune and I said no, but Gaffoor became aggressive.”
Square said Gaffoor then fetched Peterson from the car and ordered him to kill McLachlan. After the gun malfunctioned, Fortune returned to McLachlan before a shot went off.
Yesterday, Daphne McLachlan told Judge Dumisani Zondi: “I woke up at 3.45am on April 9 and saw that Vicky’s bedroom light was still on. She wasn’t there. I tried to phone her on numerous occasions, but there was no reply.
“I drove to the Tavern ‘n Ale and one of her friend’s homes to see if her car was there, but it wasn’t.
“It was only when I went to the Diep River police station a second time that a missing person report was filed.
“We made flyers and helped police comb the area to look for her. The day before she was found, the search was called off and we were informed that her body had been found.
“I asked to see her body but the police advised me against it because (it) was in a bad state.”
She said Vicky was a part-time waitress who had been studying at a business college when she was murdered.
“She only completed one term.
“She went missing on the second day of the second term.
“I never saw my daughter’s body before she was buried. I am hurt. She was just becoming a woman. She didn’t deserve to die like that.”
The trial continues on Wednesday.
