Trial within Petersen murder trial

The two hitmen who allegedly carried out instructions to murder musician and entertainer Taliep Petersen, will tell the Cape High Court that police investigating the killing forced them to make statements in which they confessed to their involvement.

The one, Waheed Hassan, alleges the police officers who carried out the arrest assaulted him and that he was also threatened on one occasion.

Jefferson Snyders does not claim to have been assaulted, but alleges that one of the detectives, Jonathan Morris, promised he would get off lightly if he confessed.

Snyders also says that, although he had been informed of his right to legal representation, the right had not been properly explained.

The men say the actions of the police amounted to “undue influence” and this is why the court should refuse to have their statements admitted as evidence.

On Friday the court will hold a trial-within-a-trial to determine whether the statements should be admitted as evidence in the trial of Hassan and Snyders as well as Petersen’s widow, Najwa, and co-accused, Abdoer Raasiet Emjedi.

The state has video recordings of the men giving their statements shortly after their arrest.

In court on Wednesday, state advocate Susan Galloway said the state was not ready to proceed with the trail-within-a-trial.

She said one of the defence advocates had only provided the state with names of witnesses on Tuesday and the state needed to consult its witnesses about this.

Petersen’s advocate, Klaus von Lieres und Wilkau SC, and the advocate representing Emjedi, Laureen Abrahams, did not object to the postponement.

Justice Siraj Desai explained that the situation the state found itself in was due to unforeseen circumstances.

The trial is to continue on Friday.

All four accused have pleaded not guilty to charges of murder, robbery with aggravating circumstances and the unlawful possession of firearms and ammunition.

So far, the court has heard the evidence of the first person to investigate the case, the man who was allegedly approached by Petersen to arrange hitmen, Petersen’s brother and a man who lived in a flatlet on the Petersen’s property.

State witness Fahiem Hendricks, who allegedly organised the hit on Petersen, spent two days in the witness stand.

He told the court of his shock at Petersen’s wish to have her husband killed but added he agreed to arrange it because he felt he owed Petersen a favour after she lent him substantial amounts of money.

He went through his cellphone records to show how many times they communicated with each other.

But she denied the allegation and claims they were involved in diamond deals together and he had sold US dollars on the black market on her behalf.
