The rapist of a five-year-old girl received a double shock as he stood in the dock in the Pretoria High Court on Wednesday – he heard his wife was going to leave him and then he was sentenced to life in prison.
Hendrik van der Kaay, 46, arrived late at court as he had to walk all the way from his home at the Bon Accord Dam.
He called his lawyer to say he would be late because he had to walk. When he was later called to hear how far he was, he said he was tired and progressing slowly.
A family member and the court orderlies eventually met him halfway and brought him to court.
‘She is no longer a normal child’ |
Van der Kaay was earlier convicted of rape and indecent assault in the lower court and the matter was referred to the High Court for sentencing.
It emerged that the child’s mother and the Van der Kaay family lived in a caravan park near Wonderboom when the child was raped.
The mother testified on Wednesday that she knew Van der Kaay and trusted him and his wife to look after her daughter in the afternoons while she was working.
When she got home on the afternoon of August 6 2004, the girl was crying hysterically. It emerged that she had been raped.
The girl was in Grade 0 at a nursery school at the time.
I once loved this man, but no more |
She was so traumatised by what had happened that she was now in a remedial school, where she is in Grade 2, the mother said.
She said her daughter had been behaving strangely since the rape. She had exposed herself at least four times. While doing that, the girl would describe the penis in detail.
“She is no longer a normal child,” the mother said.
Van der Kaay begged not to be sent to jail. He said he had a wife and two children who depended on him.
He insisted that he was not guilty, saying he could not have been in two places at the same time. He claimed he was at work during the time of the rape.
“I was shattered when the court convicted me. I have been convicted wrongly,” he said.
Erasing his “wonderful and happy marriage of 13 years” by sending him to jail was, in itself, a harsh sentence, he said.
He confidently called his wife, Thea, to the stand to testify about how her life would fall apart if he went to jail.
She, instead, said she was going to leave him.
She further informed the court that he did not look after the children, as they had been taken away to an orphanage.
The final blow was when she told the court: “They were taken away as I suspected they had also been subjected to some form of molestation.
“I once loved this man, but no more. I am not lazy. I will get a job and work to look after myself.
“The law must take its course.”
Van der Kaay stared at her in disbelief.
In sentencing him, Acting Judge Chris Eksteen said the court did not have words with which to express its disgust about what he had done.
He said the court had recently dealt with many cases where women and children fell prey to rapists.
The judge said because Van der Kaay could not look after his family, they had to live in a caravan park, where there were many children. “You exploited this,” Eksteen told him.
The child’s mother afterwards said she was happy with the sentence.
“He got what he deserved. He always told me he loved my child. I will never forgive him,” she said.
Thea Van der Kaay burst into tears when asked how she felt.
“It is not nice to see your husband taken down to the cells to serve a life term.”
