A Khayelitsha man, standing trial along with four others for the robbery at an Observatory restaurant which led to the death of a patron, claims he was hijacked on the day of the incident almost four years ago.
Zolani Magida, 39, was testifying in the Cape High Court where he is accused of aggravated murder and robbery along with Phumla Qunta, 29, Xoliswa Mavalaliso, 36, Lindile Nqwala, 28, and Lungisa Sijatu, 30, for the armed attack in the Wild Fig restaurant on June 28, 2004.
On Thursday Magida’s attorney, Deana Haldenby, indicated that he, along with Nqwala, would not ask for a discharge as earlier indicated.
The five are accused of dining at the restaurant on that evening before robbing customers and staff at gunpoint.

John Boardman, 63, was shot in the chest after he intervened when his son-in-law’s wallet was grabbed by one of the robbers. Boardman died a day later at Vincent Pallotti hospital.
On the stand, Magida testified he had been hijacked at a service station in Site B while driving his sister’s car and he was bundled into the boot just after 5pm. Magida said at a certain spot, his hijackers parked for a long while before they drove off again.
“Whilst the car was moving I heard police sirens … I prayed for the police to reach the vehicle. I could hear things hitting the car, only later realising these were bullets,” said Magida.
He later testified hearing screams from the passengers as they escaped from the car, but said he could not tell whether they were male or female.
“(Inside the boot) I noticed the passenger seat was not clamped properly and that I could move it,” said Magida.
He claims to have escaped by pushing the backseat forward.
“I got out from the right back door. I noticed policemen a distance away looking into the veld,” said Magida.
All five suspects were arrested near the Mew Way bridge off the N2 highway in Khayelitsha after police chased their blue Opel Monza.
Magida said: “I thought of going to them for help and decided to get on my knees.”
He testified that police assaulted him.
