Pretoria – Two former policemen and a reservist were on Wednesday convicted of abduction and murder in the Pretoria High Court.
Judge Khami Makhafola found Magiel Burger, Felokwane David Goqo and Joachim Prinsloo guilty of abducting and murdering Putco theft suspect Sandy Botomane seven years ago.
A fourth man, former policeman Henry Beukes, was earlier acquitted on both charges because there was no evidence against him.
Illegal ticket machine found
Botomane’s mutilated body was found on the N1 highway near Vanderbijl Park on May 24 2000 after he was allegedly questioned in connection with a R1.2m theft from Putco.
The State alleged the accused had murdered him and left his body there to make it appear as if a traffic accident had taken place.
An illegal ticket machine was found in Botomane’s possession a few days before his death and a polygraph test identified him and other Putco employees as suspects in an earlier R1.2m theft.
Judge Khami Makhafola rejected the accused’s claims that Botomane was still alive when they last saw him and had run away after saying he would point out the house of a fellow suspect.
He said it was clear that Botomane had been abducted and lured away from his home by “cunning”. The accused told him and his family they were taking him to the Atteridgeville police station, but never did.
The judge rejected Burger’s evidence, as well as the evidence of two of his colleagues, that he had been on a police operation when Botomane died.
Bail extended
He said once this defence fell away, there was circumstantial evidence that the three accused had remained in Botomane’s presence until his death.
They had not given an adequate explanation that could be reasonably true, which meant that they and they alone were expected to explain Botomane’s presence.
The three men’s Counsel, Jaap Cilliers SC, earlier argued that the State had not even proved that Botomane had been murdered, as he could just as well have been the victim of a traffic accident or more sinisterly of his co-conspirators in the illegal ticket machine scam.
The trial was postponed to October 23.
Bail was extended for all three accused, but they may not leave Gauteng without permission and must report to their nearest police station once a day.
