A man accused of murdering and robbing Pieter Fismer at Sweetwater Farm in July 2003 denied guilt in the Grahamstown High Court on Monday.
He claimed that Fismer had “made advances of a sexual nature and had tried to shoot him”.
Fismer, 57, who lived alone on the farm was employed as a manager.
Appearing before Judge Ronnie Pillay was Dean Malgas, 22, of Port Alfred.

In his plea explanation read into the court record by Legal Aid Board-appointed advocate Deon Geldenhuys, Malgas claimed that Fismer had “tied him up and wanted to perform sexual acts with him.”
He also claimed that he and Fismer, after performing community service at the Port Alfred police station together, had bought alcohol and returned to the farm “where they both drank 12 beers each, a bottle of mampoer and a bottle-and-a-half of whiskey.”
The state alleges in its indictment that, during the course of the day on July 19, Malgas had shot Fismer twice with Fismer’s .22 revolver and tied the fatally wounded man to the sofa, robbed him of R2 100 in cash and fled the scene.
According to the charge sheet Malgas then handed Fismer’s gun to Port Alfred police and claimed that “Fismer had become violent after getting drunk and had shot himself.”
Port Alfred police Inspector Joseph Marais told the court he had received a telephone call from Malgas later that day asking them to send a police van, because “Fismer had become violent, had a gun and was threatening to commit suicide.”

Cross-examining Marias, Geldenhuys told him that “my instructions are that the white man shot at my client twice, and that he had been tied up by the deceased who made advances of a sexual nature towards him.”
Marais said he was unaware of this as he did not go to the farm but only received the call from Malgas who had not mentioned “anything about being shot at”.
The state contends that after Malgas handed in Fismer’s gun, he was escorted back to the farm by police, where it was found that Fismer had managed to free himself from the ropes, and had crawled into the bedroom and died form loss of blood.
Medical evidence indicates that he was shot in the upper thigh and right shoulder.
Malgas is out on warning after spending a lengthy period of time in jail as an awaiting trial prisoner.
