Modise laid no theft charge – lawyer

Businessman Charles Modise did not lay a charge of theft or fraud about money donated to the SA Communist Party (SACP), but merely laid a complaint about accountability, his lawyer said on Monday.

However police insist they are investigating a charge of theft based on a complaint Modise made.

Modise’s attorney, Zehir Omar said: “He complained to the police about the abuse of accountability. He is not asking for the return of the money. He is not saying they stole the money.

“He hoped the police would investigate and he hoped the investigation would trigger more action as far as accountability was concerned.

“He did not go there in the hope of charging anyone and having anyone investigated.”

Omar said Modise wrote the complaint at a police station and signed it.

He said Modise gave the SACP money in 2002, reportedly R500 000, when he heard the SACP was experiencing financial difficulties.

He did not want workers to lose their representative voice, so handed the money over in cash so that the SACP could meet its salaries and wages, telephone account and other overheads.

“He gave it in cash to prevent other creditors getting a garnishee order against their bank account,” continued Omar. “The SACP could do what they wanted with the money, but they had to be accountable.”

Over the years Modise had tried unsuccessfully to get a satisfactory answer on how the money was spent so decided to go to the police.

“The purpose of going to the police was not to lay criminal charges,” said Omar. “The objective was to get accountability from the SACP on what happened to the money.”

“He (Modise) has the highest regard for Blade Nzimande (SACP secretary-general) and other SACP leaders,” he said.

“The complaint was concerning a lack of accountability. There was no charge of theft.”

He said the complaint still stood and would not be withdrawn.

Police spokesperson Director Govindsamy Mariemuthoo said a theft charge was laid two weeks ago by Modise, but not against anyone in particular. It related to money given to the SACP.

“There was a theft charge laid. Police are busy with an investigation,” said Mariemuthoo. – Sapa
