Five men in court for ‘revenge’ killing

Five Bathurst men appeared in the Grahamstown High Court on Monday, accused of hacking a man to death in an apparent revenge killing.

On trial under the doctrine of common purpose of murder were Anelisa Sweli, 18, Thembela Mbanzi, 19, Sithemble Jobela, 21, Lungile Mbanzi, 19, and Milile Ngiwa, 26.

They are accused of murdering Luvo Mzozayana, 22, on the night of December 15, 2006, in Gedze Street, Bathurst.

Mzozayana is alleged to have killed Ngiwa’s brother some time in November and the charge sheet indicates the murder “was motivated by revenge”.

Before the trial began and was presided over by Judge Andre Erasmus, state advocate Heinz Obermeyer withdrew charges against Jobela, but did not cite reasons for the withdrawal. It is not clear whether Jobela will become a state witness in the trial.

No charges were put to the accused in the dock and no pleas were entered.

However, the withdrawal of charges against one accused meant a series of lawyers’ consultations with their remaining clients, which delayed proceedings further.

The state’s indictment states that the accused and others encountered Mzozayana in the company of another person and that Ngiwa had “immediately recognised him as he tried to run away.”

According to the charge sheet, Ngiwa then produced an axe and struck Mzozayana from behind as he tried to flee, as the accused and others chased him.

“After the deceased had fallen to the ground, the accused and others set upon him and started stabbing and hacking him with an assortment of weapons including an axe, sword(s), pangas and a knife/knives.

“During the sustained attack on Mzozayana, one of the accused, or one of the others, uttered the words: ‘Milile’s brother is dead because of you.'”

The state further alleges that as the crowd began to leave someone noticed that Mzozayana was still moving and they returned and continued to assault the dying man.

According to papers before the court, Mzozayana died at the scene from multiple injuries to his head and neck.

Police originally arrested seven people in connection with the murder, but only five were identified in a line-up parade. The state intends to call 17 witnesses.
