Eight youths to stand trial for ‘murder’

All of the eight youths accused of the attempted murder of restaurant manager Andrew Merryweather will stand trial in the Wynberg regional court, despite representations by their lawyers to have charges dropped against some of them.

On Friday the case against Samuel Davidson, Michael Enslin, Shane Woldendorp, Dane Killian, Justin Maxwell, Joel Thackwray, Liam Hechter and Oliver Scholtz, all 18 years old, was postponed to April 5 for a regional court date.

The youths have been charged with attempted murder and intent to commit grievous bodily harm. They are accused of an attack at a Newlands petrol station forecourt that left restaurant manager Merryweather partially paralysed.

Unlike their last appearance, all eight men filed into the dock early on Friday. Last month Davidson, Enslin and Hechter were allowed to skip their appearance because they had started university.

On Friday defence attorney William Booth read out a letter sent to the defence teams in which the director of public prosecutions stated: “After careful consideration of the matter, I have decided that prosecution proceedings in the Regional Court against all the accused on a charge of attempted murder (and) assault with intent to do grievous bodily harm (will) proceed.”

Booth told the court that police investigations were complete and the defence needed copies of all the additional statements that had been taken by them.

Booth said that although the case had been postponed to on Friday for a regional court date, the person responsible for allocating dates was at a conference. “Last time a big thing was made of my clients not being in court, but they are all here today. My clients are all studying and (Samuel) Davidson is studying at Rhodes. He specially flew down for Friday’s appearance.”

He asked that the return date fit in with his clients’ holiday period.

Merryweather, who attended court proceedings on Friday, told the Cape Argus he was pleased about the outcome of the case so far.

Outside court on Friday a few Merryweather supporters held placards reading: “Can money buy legs?” and “Pollsmoor for violent criminals”.

Attorney William Booth is representing all of the accused except Woldendorp, whose lawyer is Ken Bredenkamp.
