THE policeman investigating the rape and robbery of a French tourist on Durban’s beachfront in December is facing a disciplinary hearing for “doing absolutely nothing” with the case for two months.

Durban regional court Magistrate Sharon Marks expressed her “extreme displeasure” on Monday at the “incompetent manner” in which the police were handling the matter.

“Not only has this case received national coverage, but also international coverage,” she said.

The magistrate was reacting to information given by prosecutor Jackie Jonk that the trial of the two young men accused of the crime would have to be adjourned because the investigating officer, Const Thamsanqa Mbedu, of the Family Violence, Child Protection and Sexual Offences Unit, had not followed up on DNA reports, or taken statements from other police officers involved in the matter or from those who had organised the identity parades.

‘Incompetent’

She said Mbedu had received the docket back from court on December 8, and had made an entry stating that he was not sure whether the docket was his or whether Durban North police were now handling the matter.

Jonk said a member of Mbedu’s unit, Inspector M Naidoo, was in court and had given an assurance that he would report the matter to his superiors, who would inquire into Mbedu’s conduct.

Naidoo had also undertaken to ensure that the statements were taken as soon as possible, and would personally go to Pretoria on Wednesday to take the blood analysis report. The magistrate granted the adjournment “because of the serious nature of the crime”.

“Notwithstanding the fact that the accused have a right to a speedy trial, the victims have a right that justice be done,” she said, adjourning the matter until April 19.

On trial are Mpendulo Sithole, 20, and a 16-year-old, who cannot be named. They are both street children, and have pleaded not guilty.

They are alleged to have attacked the 26-year-old French tourist and her boyfriend as they sat watching the ocean near the paddling pools at North Beach, raping the woman and robbing her boyfriend. The tourists both testified in December just two days after the incident at a speedily arranged trial because they were leaving South Africa.

Both accused are in custody. Sithole, who cried during the brief hearing, complained that he was being “harassed” and had been assaulted by fellow inmates. The magistrate said she would request that he be kept in isolation.
