S.Africa: Police gang rape a woman. State is liable

[The Police are supposed to serve and protect. But in South Africa, they seem to be becoming almost as bad as the criminals. This is an example of the declining standards and the slow corruption of everyone by our new system. Whites said stuff like this would happen. Now its reality. Jan]

Johannesburg – The State was directly and vicariously liable for the gang rape of a woman by three policemen, the Constitutional Court heard on Tuesday.

This was because it was the job of the three policemen to protect her after they had offered her a lift home and she had accepted, said Wim Trengove, appearing for the rape victim.

“This is not the same as a transport contractor not being liable for a lift given by a driver,” he said.

“It was their job to help people in distress and that is why they took her home.”

It was also the policemen’s constitutional and private duty to ensure her safety.

“It would have been foolish in the extreme to get into the car with three men if they had not been officers of the State.”

Trengove said they were on duty, in uniform and carried badges at the time of the attack.

The three policemen have since received prison sentences for the attack.

The woman is asking the court for leave to appeal a Supreme Court of Appeal ruling that the minister of safety and security was not responsible for the attack.

She believed she has a constitutional right to protection from violence, regardless of the source of that violence.
