Major Kivihya, 63, told the TJRC sitting at County Hall which was chaired by Margaret Chava that Raila “used to meet Snr Private Hezekiah Ochuka who led the coup attempt by KAF’s junior officers at a house on Fourth Avenue, Ngong Road in Nairobi owned by a Prof Otieno”.
At the time, KAF was under General Peter Kariuki with General Jackson Mulinge as the Chief of General Staff and President Moi was the Commander in Chief. The ex-major recalled and named Lt Mwambura, Cpl Odira and Cpl Oriwa as key players in the coup attempt that resulted in the loss of “around 300 lives half of whom were university students and civilians”.
In a presentation backed by Capt Gideon Mutoro Musukuya, Major Kivihya told commissioners Maj Gen (rtd) Ahmed Farah, Judge Gerturde Chawatama, Prof Ronald Slye, Amb Berhanu Dinka and chair Tecla Namachanja that although Raila was later acquitted of involvement, we believed “he was involved in the plot to overthrow Moi”.
He said that a day after the attempted coup, President Moi ordered that all air force men be arrested and taken for hanging at Kamiti Prison. The directive was effected and sevicemen and officers were taken to custody at Kamiti, Naivasha, King’ong’o and Shimo La Tewa prisons.
Maj Kivihya told his listeners that President Moi appointed Brigadier Kibwana and Major Musomba to conduct interrogation and torture. Immediately, torture was intensified and conducted by Major Mbewa and Major Githiora to yield forced confessions whereas others like Cpl George Wanyonyi and Maina Wachiye were never tried but imprisoned.
Kivihya added that four categories of KAF airmen emerged during their arrest: those with prior knowledge, those without prior knowledge but were imprisoned or hanged and those who stayed in prison but could not be charged for lack of evidence. “Only a quarter of the airmen who knew of the plot raised the alarm at Eastleigh and Nanyuki stations. And as a military rule, everyone responded and armed themselves in expectation of the next order. Cpl Odero ordered men to go to town and wait for the next order which did not come,” he narrated.
