THE repeatedly-interrupted trial of the two men accused of robbing and murdering a German flight instructor in Windhoek at the end of 2005 has again been delayed.
The trial of Dumingu Zuzee da Costa (41) and Joseph Wasuka Nunda (34) is now scheduled to continue only from January 16 next year.
By then, five years will have passed since the date when the burned remains of German flight instructor Ralph Köhnke (34) were found in the Goreangab Dam area in Windhoek. Da Costa and Nunda will also have been in custody for more than five years when their trial continues.
Both men pleaded not guilty to counts of murder, robbery with aggravating circumstances and defeating or obstructing the course of justice, alternatively violating a dead human body, when their trial started before Judge Nate Ndauendapo in the High Court in Windhoek on September 17 2009.
The trial continued last week, after an almost year-long break in proceedings. On Thursday, it was postponed again, to January 16. Da Costa and Nunda were told that earlier dates for the continuation of the trial could not be found, as Judge Ndauendapo is fully booked with other cases until then.
Da Costa and Nunda are accused of killing Köhnke in his house in Windhoek on December 26 2005. Köhnke was allegedly struck on the head with a brick or other object, and died due to a skull fracture.
His body was discovered near the Goreangab Dam on December 29 2005.
The prosecution is alleging that after Köhnke had been killed, Da Costa and Nunda loaded his body in a car, transported it to the area where he was later found, and then set the body on fire in an attempt to destroy evidence of the alleged assault on Köhnke.
It is also alleged that the two men stole goods including computer equipment, tools, a safe, two firearms and an unknown amount of money in cash, from Köhnke’s house after he had been killed.
Da Costa and Nunda were arrested early in January 2006.
The trial continued last week with Da Costa testifying in a trial within a trial to determine the admissibility of statements that he and Nunda made to Police officers after their arrest. Both men have objected to these statements being used as evidence in their trial. They are claiming the statements were not made freely and voluntarily and that they were mistreated by Police officers before making the statements.
Da Costa is being represented by lawyer Christian Nambahu. Winnie Christians is representing Nunda. State advocate Belinda Wantenaar is prosecuting.
