The Association of Senior Staff of Banks Insurance and Financial Institutions (ASSBIFI), has written a protest letter to the Minister of Labour and Productivity, Chief Chukwuemeka Wogu on the mass sack by the management of First Bank, Afribank, and Unity Bank.
The union said the action was a flagrant disobedience of Section 20 (1) (C) of the labour Act that stipulates steps to be taken on disengagement of workers from service and vowed to pick the affected banks next week.
ASSBIFI has also warned that if the management of Unity bank refuses to reverse the mass sack by January 6, 2011, the workers would have no choice than to paralyse its business activities across the country.
In the letter signed by its Deputy Secretary General, Olamosu Abiodun and Assistant Secretary General, Omotaje Olawale, the union claimed that while the federal government is pursuing the policy of job creation, promotion and protection by bailing out unhealthy firms in the banking, aviation and textile sectors, some other employers are going in the opposite direction in an unprocedural and anarchistic style.
“We are constrained to write this protest letter to your office on the recalcitrant posturing of the management of some banks that include; First Bank Nigeria Plc, Afribank Nigeria Plc and Unity bank Plc in their resolve to continuously and flagrantly disobey the laws of the Federal Republic of Nigeria as it relates to their execution of staff rationalization exercise without following due process in line with the provision of Section 20 (1) (C) of labour Act and part 11,( Section 1), Article 5 (b) of the existing industry-wide collective agreement which stipulates the steps to be taken before carrying out such exercise,” part of the letter reads.
According to ASSBIFI, the management of both First Bank and Afribank have developed penchant for carrying out an annual ritual weeding out of their employees since 2004 but usually follow due process by negotiating the terminal benefits of the affected staff with their respective unions as required by laws and existing industry-wide collective agreement.
“We wonder therefore, why these banks have decided at the end of the year 2010, when the whole of humanity are exchanging goodwill messages, to throw our members into the harsh unemployment market and their families to uncertain future by refusing to negotiate their terminal benefits”, it said.
ASSBIFI also recalled “that in 2009, management of Unity bank sacked 230 of our members and despite the intervention of the then Minister of Labour and Productivity, Adetokunbo Kayode and other stakeholders, the bank is yet to properly negotiate and pay the terminal benefits of the affected staff.
“In effects, 36 of our members were affected by the last week assault on their rights and an additional list of staff is being compiled as we put finishing touches to this memo.
It warned that “if the management of Unity bank refuses to reverse the mass sack by January 6, 2011, we will have no choice than to paralyse its business activities across the country in a manner that would make the recent shut down of Union Bank Plc a child’s play to serve as a deterrent to others that are noted for anti-labour activities.”
