Durban – A man who was stabbed and beaten during an attack at Durban’s Kennedy Road informal settlement last year bust into tears in court on Tuesday when he recounted what happened.

“They stabbed me six times with sharp iron objects, my shoulder was cut with a bush knife and they beat me with sticks,” Dumezweni Cibane told the Durban Regional Court with tears on his face.

He was describing how he and several other people were attacked outside a community hall in the area on September 27 last year.

Thabani Ndlovu and Thokozani Mnguni were stabbed and beaten to death, and scores injured when about 40 men carrying assegais, knobkerries and guns attacked them.

Twelve men were arrested and were out on bail.

Cibane was so emotional during his testimony that the court briefly adjourned to give him time to compose himself.

He said he was going to an outside toilet when he was confronted by a group of about 30 people who started stabbing him.

“I raised my hands and asked why I was being attacked. I also told them that I was Cibane and that my wife worked at the hall, but they continued to attack us.”

Cibane said he managed to escape after he rolled down a slope and onto a rubbish dump.

“When I was there, I heard people crying and I thought they were killing my children.”

Cibane pointed out accused number two, Thokozani Mthwana and accused number nine, Samekilis Mkokelwa as being among the people who attacked him.

Jimmy House, the lawyer representing the 12 people accused of the attack, told the court on Tuesday that he had been told there was conflict between Xhosas and Zulus about houses and jobs before the violence.

The other accused are Simvumile Limaphi, Thoboxolo Mazela, Sibulelo Mambi, Khaliphile Jali, Zandisile Ngutyana, Situtu Koyi, Sicelo Mabi, Zamandla Mazeka, Nkosiyezwa Njiyela and Fundisile Nkoyi.

Only Mambi, Jali, Ngutyana, Koyi, Mabi and Mkokelwa have been charged with murder.

Koyi was also charged with robbery and attempted murder. Limaphi, Mthwana, Jali, Koyi, Mabi, Mkokelwa, Mazeka, Njiyela and Nkoyi also face charges of attempted murder.

All of them pleaded not guilty to all the charges.

Princess Mbangwa told the court she heard people screaming inside the shebeen being attacked allegedly by members of the community policing forum known as Wanya Tsotsi.

The forum was formed by Abahlali Basemjondolo, the organisation that represents shack dwellers countrywide.

This was after residents had gathered and vowed to beat Wanya Tsotsi members for harassing people.

The forum allegedly began a curfew and beat people who walked at night, she said.

Residents were also calling for the Pondos (Xhosa) to be chased out of the settlement, she said.

“Most members of the forum were Xhosas,” she said. The forum had been formed by Sbu Zikode, Abahlali Basemjondolo leader, without consulting the community, the court heard.

Mbangwa said she had also heard that tensions between members of the forum and the residents had began after a brother of an African National Congress (ANC) representative had allegedly stolen money from Zikode’s child.

The ANC representative was only identified as Zandile.

“She (Zandile) took over as a leader of the community after Zikode left the settlement immediately after the attack,” she said.

Mbangwa told the court she had been drinking with Ndlovu just before he was killed.

“I was in the toilet when I heard people screaming. When I went back I found Vusi Mkhize lying in a pool of blood. She had been stabbed. Other patrons were being chased by a group of about 13 people,” she said.

Ndlovu’s body was found near the shebeen.

She said she had noticed that Njiyela was among the people who were chasing patrons. She said it had been easy to identify him because she was an albino.

“I was however unable to see which albino it was because we had two albinos in the area,” she said.

The trial continues.
