Harare – The three principals to the Global Political Agreement met in Harare yesterday to review their negotiators’ report on implementation of the concord that led to the inclusive Government’s formation.
Sources said, among other things, the report dwells on procedures pertaining to governmental processes and functions such as operations of Cabinet and the Council of Ministers.
President Mugabe, as Head of State and Government and Commander-in-Chief of the Zimbabwe Defence Forces, chairs Cabinet while Prime Minister Morgan Tsvangirai heads the Council of Ministers.
“The negotiators agreed on Cabinet process and the Cabinet Handbook governing the procedures of the highest executive decision-making body.
“The negotiators also agreed on Council of Ministers processes, composition of the various Cabinet committees and legislative matters.”
The sources said — without elaborating — that the negotiators’ report also contained their agreement on issues such as external interference, Reserve Bank Governor Dr Gideon Gono, Mr Roy Bennett, ministerial allocations, hero status, land, electoral processes and parallel government structures in the PM’s Office.
An insider denied media reports that the principals met last week, while adding that the meeting between President Mugabe and PM Tsvangirai had resolved the issue of the recent appointment of a Supreme Court and four High Court judges.
“There cannot be a meeting of principals when one of them is not in attendance and last week Deputy Prime Minister (Arthur) Mutambara was not present.
“It was a meeting between the President and the PM. President Mugabe patiently explained to the PM that the judges were appointed through an internal authority, namely the Law Society of Zimbabwe.
“It must be borne in mind that the Law Society has many people sympathetic to PM Tsvangirai and he agreed that it was doubtful they would act against his interests.
“President Mugabe said he had merely formalised the appointments acting on the advice of the Law Society, the Chief Justice and the Judicial Services Commission.”
Asked what the PM’s response was, the insider said: “Well, it does not really matter whether or not he was satisfied because that is the legal position. Matters of the law are not there to give political satisfaction. Perhaps even President Mugabe is not happy with the processes, but the law is the law and it must be fulfilled.
“The matter is now closed.”
Last month President Mugabe formally appointed Justice Rita Makarau to the Supreme Court while Justice George Chiweshe took over from her as Judge President of the High Court.
Also appointed to the High Court were Justices Andrew Mutema, Garainesu Mawadze and Nicholas Mathonsi.
PM Tsvangirai reportedly wrote to President Mugabe complaining about the appointments.
However, observers said the appointments were done constitutionally and PM Tsvangirai could not expect judges to be appointed according to the partisan considerations of political parties.
