South Africa: Court scrutinises footage for clues in murder

A DVD and video tape of murder accused Mohamed Shuaib Sathar sitting in his father’s shop on the morning of September 15, 2005 was on Tuesday entered into evidence at the Pietermaritzburg High Court.

Sathar is on trial for the murder of his 21-year-old cousin, Safia Asmal, in her home on the same day.

The slightly-built 23-year-old has pleaded not guilty to the murder.

Asmal was stabbed 10 times in the back, her skull was fractured and her throat slit.

The state alleges that Sathar went to Asmal’s home with the intention of killing her.

It says the two became involved in an argument and Asmal was struck over the head with a dumbbell, after which Sathar allegedly used a bread knife to stab her.

Testifying on Tuesday at the start of the defence case was Sathar’s father, Asgar.

He produced the video tape of CCTV footage in his shop in Estcourt that shows Sathar sitting there for a period of time.

The contents of the tape were transferred onto DVD, which was also entered into evidence. Viewing the DVD on a laptop computer in court on Tuesday, Asgar confirmed that the DVD showed Sathar in the shop one hour, 51 minutes and 41 seconds into the recording.

The DVD then shows Sathar leaving the shop 23 minutes later. However, the actual time of day is not recorded on the CCTV footage.

His voice cracking with emotion at certain points, Asgar described the relationship between his son and Asmal as “very close”.

‘They spent a lot of time together, visiting each other and listening to music together. When my son was hospitalised in 2005, Safia would visit him in hospital,” he said.

On the day of the murder, Asgar said that he had gone to work at about 8am.

He explained that he has a main electrical shop, with a smaller “extension” shop which he monitors via CCTV.

He got a call from his wife an hour later, telling him that Sathar was refusing to go for his driving lesson and had torn up his learner’s licence.

“I was very upset by this,” he said, adding that at around 11am, he saw his son passing his shop.

“I stopped him and we had an argument about what he had done with his learner’s licence. I told him to go home because I was busy,” Asgar said.

Asgar later received a phone call from Asmal’s brother telling him that she had been killed.

He said he left work to go home and pick up his wife. On the way, he saw his son at the Value Lodge, 100m away from his shop. “I picked my son up, we fetched my wife and drove to Safia’s house,” he said.

The matter was adjourned to Wednesday to allow for the prosecution to view the DVD and to verify the estimated distances.
