The family of a victim of an accident, in which a pedestrian was killed and three others wounded when a Pinetown police van hit them, are angry, saying the case has been “brushed under the carpet”.
They have waited for six months to hear if the case against the driver, a policeman, will go to court. Police blame the KZN Health Department for holding up the post mortem results.
Despite the Daily News asking the health department to comment on the case for more than a month, it had very little to offer other than a blanket denial that that a post mortem result could take longer than 14 days.
Cyril Gwala died and Thembinkosi Duna, Joseph Nyathikazi and Scelo Jinjela were seriously injured when the van ploughed into them on Richmond Road, Pinetown, on November 18.
Police said at the time the driver went through a stop street, hit two pedestrians waiting to cross at an intersection, then hit another two people before going through the fence of a car park and stopping against a concrete wall.
The two police officers in the van were injured and taken to St Augustine’s Hospital, while the injured pedestrians were taken to RK Khan Hospital in Chatsworth.
Speaking to the Daily News yesterday Sli, the sister of Duna who sustained severe head injuries during the accident, said her family and the families of the other victims were tired of waiting and have started to think that the case will never go to court because a policeman was allegedly responsible.
“My brother’s hospital files have also gone missing, so we can’t even make a claim with the Road Accident Fund. We just want to know what is happening with this case so we can go on with our lives.”
The police officer who was driving the vehicle spent three weeks at home recuperating. He is currently on duty at Pinetown Police Station.
Police say the case has not gone to court because they have not received the post-mortem results from the KwaZulu-Natal Department of Health.
Pinetown police spokesman Solomon Mbhele said on Thursday: “Why should we say we have them when we don’t?
“The department has still not given them to us and we are still waiting,” he said.
When previously asked about the delay with these results, health department spokesperson Leon Mbangwa said it was “utter nonsense” that the police were waiting for the results for such a long time.
He reiterated his comments on Friday morning, saying that 14 days is the longest one would have to wait for post-mortem results.
He advised the families of those affected to make a formal complaint with the Independent Complaints Directorate.
“I will also look into this issue to see where the hold up really is.”
