The man who is alleged to have killed his 13-year-old daughter by slitting her throat, will remain in custody pending a decision by the Director of Public Prosecutions.
Rashaad Kruger, 47, appeared briefly in the Wynberg Magistrate’s Court on Tuesday.
His legal aid attorney Imran Rhode asked that the charges against his client be dropped, as the matter had been on the court roll since April.
Rhode said the DNA results had been outstanding for the last three court appearances and that the docket was not in court.
Prosecutor Nellie Joni had asked for another postponement as the docket was with her seniors who had to decide on further trial proceedings.
Magistrate Hafiza Mohamed ruled in favour of the postponement, saying Kruger faced a serious charge and that previously the court had heard he would be tried in the high court.
The State alleges that Kruger killed his daughter Moeniba on March 21 when he realised she had witnessed his attempt to rape her friend.
The attempted rape is alleged to have occurred after his parole on a separate rape conviction.
Kruger served a 10-year sentence for raping another of his daughters and was released early in 2007.
Moeniba’s body was found in her locked room at the family’s Walton Road home in Retreat. Kruger was arrested in connection with the murder in Delft the following day.
On April 11, he abandoned bail and has been in custody since then.
Magistrate Mohamed remanded the accused and postponed the case to March 3.
