Alleged Americans gang boss Mogammat Sedaka Madatt will spend an effective 10 years in prison for his involvement in drug and diamond dealing in two separate cases.

Madatt, 39, appeared before Magistrate Victor Gibson in the Cape Town Regional Court on Friday.

In both cases Madatt was arrested following sting operations by undercover police officers. The cases involved dealing in drugs and in uncut diamonds.

In the first case he was given a 15-year jail sentence, of which five years were suspended on a charge of dealing in cocaine, and another three-years suspended for dealing in uncut diamonds. In the second case he was jailed for 15 years, of which five were also suspended.

He will serve the two jail sentences concurrently, meaning an effective 10 years in jail.

Madatt and three co-accused Mogamat Richards, Rashied Richards and Madatt’s wife Zakira Madatt were arrested in 2005 in connection with drug dealing and diamond smuggling.

Madatt was found in possession of 1kg of cocaine with a street value of R500 000 and two uncut 13 carat diamonds valued at R82 700.

On Friday Madatt changed his plea to “guilty” on the charges of dealing in cocaine and diamonds.

When Gibson told Madatt’s co-accused that all charges against them had been withdrawn, Madatt’s wife Zakira broke down as she stepped down from the dock.

Koos Louw, for Madatt, told the court that Madatt was married with 12 children, the youngest born this year. His schooling had gone up to just Grade 8 and he had grown up in difficult circumstances.

He said he had built himself up as businessman and that he had been involved in crimes based on his previous convictions.

Johan Swart, for the state, argued that Madatt’s involvement in drugs was a threat to society, especially in the Western Cape.

Immediately after passing sentence on the cocaine and diamond-dealing charges, Gibson began hearing the second case, in which Madatt was arrested at a Southern Sun hotel in the city centre on June 9 in connection with making or supplying tik (methamphetamine) and dealing in an undesirable and dependence-producing substance.

Police seized Madatt’s car and confiscated about 1kg of tik and R20 000. Madatt gave an undercover agent ephedrine, an ingredient used to manufacture tik, on May 8 and received 1.5kg of tik with a street value of R20 000 on June 9.

Police said they had footage of the exchange.

He was found guilty and jailed for 15 years, five suspended.
