S.Africa: Men get life for killing guards

Johannesburg – Two men were jailed for life by the Johannesburg High Court on Wednesday for murdering two Fidelity Guards during a staged “cash in transit heist” in the Lenasia area in 2002.

R800 000 was stolen and the guards, who had agreed to play along, were “unjustifiably shot dead in cold blood.”

The court imposed two terms of life imprisonment on Ayoob Toffie and Ephraim Mchunu each for the murder of Arthur Dawson and Selai Mosia.

The evidence of former Fidelity Guards employee Arnold Sutton, serving 30 years imprisonment after standing trial separately last year, that Toffie was armed and that he shot Mosia and Dawson was accepted by the court.

Forensic evidence that Dawson’s blood was found on a jersey worn by Toffie on that day, October 9 2002, was also accepted by the court.

For the theft of the money, two firearms and illegal possession of a gun and ammunition, a further 16 years imprisonment was imposed.

Assets seized

The two life sentences and the 16 years would be served concurrently.

The assets of Toffie, 33, of Delmar Gardens, were seized and placed under a restraining order late last year.

The date for the forfeiture inquiry of Toffie’s assets was on Wednesday set for July 22 this year.

Mchunu, 42, is a grandfather from Daveyton on the East Rand.

It was found by the court that although he did not pull the trigger, he knew Toffie was armed, foresaw the possibility of violence and recklessly accepted the consequences.

Mchunu was sentenced to a further 13 years imprisonment for theft and illegal possession of a gun.

The mastermind, a former Fidelity Guards employee, Clive McKenzie, 40, of Klipspruit West, was at work at the time of the fake heist in the Lenasia area.

Because he participated in the “careful planning”, he was convicted of theft and sentenced to an effective seven years imprisonment.

“The violent conduct of the accused has left a trial of tragedy and loss,” acting judge Simon Radasie said, adding that the accused did not show remorse.
