This quote from The Lord Of The Rings trilogy was offered on Tuesday by Theuns M(246)öller, counsel for Manuel Azel, 27, who had pleaded guilty to murdering an elderly couple in Genadendal in August 2001.
M(246)öller had completed his argument in the Cape High Court and was asked a number of questions by Justice Nathan Erasmus. He replied that he had nothing to add to his argument, but would leave the court with the words by JRR Tolkien.
Azel used an axe to chop off part of Hendrieka Wyngaard’s head and to stab her husband, Christophorus, 28 times. He also pleaded guilty to robbery with aggravating circumstances.
He said his actions were influenced by the Mandrax and cocaine he had beforehand.
In mitigation of sentence, he said Wyngaard had sodomised him when he was 10 and the incident had ruined his life.
Wyngaard had threatened to harm him if he told anyone and had given him a R5 note to keep him quiet, he said.
Arguing in mitigation of sentence, M(246)öller said the evidence about the R5 note indicated Azel had not lied about being sodomised. If he had been lying, he would have spoken of a R5 coin. Also, the drugs had made him more aggressive. Azel had pleaded guilty and shown remorse.
Esna Erasmus, for the state, argued that a psychologist had said Azel didn’t really show remorse. The way in which the couple were murdered showed Azel intended to kill them. An aggravating factor was that the couple were elderly and Mrs Wyngaard was bedridden.
The sodomy claim should not be taken into account. Erasmus asked the court to impose life sentences for the murders and 15 years for the robbery.
Azel is expected to be sentenced on Wednesday.
