A Travelgate accused said on Monday that his trial could not continue until Judge Sisi Khampepe’s full report on the conduct of Scorpions was officially released.

The State now has two days within which to reply to ANC MP Mnyamezeli Booi’s request to postpone his trial in the Cape Town regional court.

State advocate Jannie Vervuuren, SC, said that Booi’s application, which they only received this morning, needed to be responded to in the form of an affidavit. Magistrate Michelle Adams warned Booi to return to court on Wednesday for the State to reply.

He also called for an inquiry as to whether there is a reasonable explanation for the trial’s delay which was due to start today and run for the next three weeks.

In Booi’s application, he refers to the Khampepe report which was expected today.

“It will be part of my defence that I have, similarly, been subjected to an abuse of power by the Scorpions and the findings contained in this report and further investigation into the conduct of the Scorpions in investigating this case is essential in order for me to prepare adequately for trial,” his affidavit read.

He also said that there were substantial errors in the PriceWaterhouseCoopers’ report against him, and that the Legal Aid Board had advised him that a financial audit on it would cost an “unaffordable” million rand. The State was ready to proceed with the trial after 28 MPs entered into plea bargains, and Booi was the only MP insisting on a trial.
