Documents relating to the investigation of charges of attempted murder, fraud and defeating the ends of justice against Ekurhuleni metro police boss Robert McBride were among those stolen during a robbery at the Johannesburg High Court.

The National Prosecuting Authority on Wednesday confirmed that the dockets relating to McBride were among those stolen from senior NPA advocate Deon van Wyk’s office on Sunday night during a daring raid on the courthouse.

“Some of the cases being investigated relate to charges of attempted murder, fraud and defeating the ends of justice,” said the Director of Public Prosecutions for the Witwatersrand, Charin de Beer.

“The said documents refer to several case dockets. I wish to emphasise that these cases are still in the investigation phase and the details thereof cannot be divulged at this stage.

“This is not part of the Pretoria drunken driving trial. These are separate incidents we are investigating. The allegations are along those lines,” said De Beer.

NPA spokesperson Tlali Tlali said: “The (drunk driving) case is part-heard and will resume at the Pretoria regional court on Monday April 21.

“The break-in at the Johannesburg High Court does not have any impact on this case and documents stolen do not include the McBride docket relating to the drunk-driving case.”

At least six robbers, dressed as policemen and armed with police-issue R-5 rifles, gained access to the Johannesburg High Court, saying one of the guards on duty at the building had been implicated in a rape case.

After locking the guards in a toilet, the armed robbers broke into the chief registrar’s office, where they stole the safe before heading to Van Wyk’s 12th-floor office.

De Beer on Wednesday night confirmed the robbers had stolen Van Wyk’s laptop, some personal documents and dockets relating to McBride, and another relating to Shanavas Khan.

The NPA would not be drawn into revealing who Khan is.

McBride is involved in a protracted legal battle in the Pretoria regional court after he crashed his official car on December 21 2006.

He faces three counts of drunk driving, defeating the ends of justice and fraud in connection with his crash.

Evidence has emerged that McBride’s men allegedly drove as far as Durban to obtain false medical certificates to cover for their boss. Three of his lieutenants have testified about alleged corruption in the Ekurhuleni metro police department, which included the kidnapping of suspects.

The SABC on Wednesday night reported McBride as saying he could not comment on something he knew nothing about and that he found it strange the way the NPA had conducted themselves.
