Michael Molefe, a former South African political activist who was found guilty on two counts of murder in a Botswana high court, was sentenced to death on both counts.
Molefe, 47, of Dobsonville, Soweto, was found guilty along with Botswana citizen Brandon Kgotso Sampson, 38, for the murder of two Zimbabwean nationals Robert Mcube and Sam Hombarume on December 24, 2000.
Sentencing the two, Judge Maruping Dibotelo said when he convicted Molefe on January 28 this year, he noted that there were extenuating circumstances for his role in the murders.
He said at the time of their death, Molefe was still emotionally unstable and stressed by accusations that Mcube robbed and killed his aunt in Soweto in 1995.
Mcube allegedly robbed the aunt of R95 000 in cash.
The judge, however, found no extenuating circumstances for Sampson and, according to the Botswana law, it obliges any judicial officer to impose a mandatory sentence of death.
Judge Dibotelo said Molefe became aware of Mcube’s presence in Botswana in 1999 and did nothing about it nor reported him to the police.
“The extenuating factors I noted in Molefe’s favour are far out-weighted by the aggravating factors.”
“Therefore, Molefe I rule that you are sentenced to death for the murder of Robert Mcube on a day to be set by the president, you shall be hanged by the neck until you die. You are also sentenced to death for the murder of Sam Hombarume on the date to be set by the president. You shall be hanged by the neck until you die.”
He was further fined P350 or three months in
jail for illegal possession of a firearm.
Sampson was also sentenced to death on two counts of murder.
He was also ordered to be hanged by the neck until he dies.
Judge Dibotelo gave them six weeks to appeal against their conviction and sentence.
