Johannesburg – The 11 judges of the Constitutional Court have slammed criminals who tried to hide behind apartheid as an excuse for committing crimes.
These criminals who are hiding behind apartheid and the part they played in the struggle in order to make their crimes less punishable, demean the honourable efforts of millions of formerly and presently disadvantaged people who are trying to make a living under difficult circumstances while following the law.
This was the ruling of judges when they rejected the application to appeal by convicted fraudster Schabir Shaik.
One of Shaik’s arguments for a lesser sentence was that he came from the apartheid era and was part of the struggle, during which he suffered much.
The judges said Shaik’s crimes started after new democracy had dawned and continued after laws were promulgated which promoted the interests of people who had suffered under apartheid.
The suppressing, discriminating past of the country could neither be used as an excuse for criminal deeds, nor could it be used to justify a reduction in an otherwise fair sentence (such as Shaik’s).
