Boeremag accused apply for discharge

At least 11 of the Boeremag treason trial accused will apply for their discharge on some of the 42 charges against them.

Counsel for two of the accused, Mike and Andre du Toit, presented legal argument on Monday in applications for their discharge on 33 of the charges against them, claiming there was no evidence linking them to crimes committed while they were in jail.

More applications are to follow in the Pretoria High Court this week.

The 22 accused in the trial – one of them has since died – denied guilt four years ago on 42 charges, including high treason, sabotage, murder, attempted murder, causing a series of explosions and the manufacturing and illegal possession of explosives, firearms and ammunition.

It is alleged that they were part of a right-wing coup plot to overthrow the government with violence.

The Du Toits and Koos du Plessis were the first of the alleged Boeremag members to be arrested early in April 2002.

Their Counsel argued that there was no evidence that they had known about plans for a series of bomb explosions in October 2002 or a plot to kill former president Nelson Mandela with a home-made bomb.

There was also no evidence that any of them had planned or carried out any crime from within the prison or that later “splinter groups” under the leadership of other accused had anything to do with the defensive objectives of the initial “self-defence” organisation, it was argued.

The accused also insisted that there was no evidence that acts carried out by a splinter group known as the Suidlanders had been aimed at overthrowing the government with violence.
