Fatal crash accused says he’s not guilty

Wesley Aver, the motorist accused of running down and killing 20-year-old Megan Jasmin in a hit-and-run incident in Durban’s Florida Road in 2006, applied for a discharge on all charges on Monday.

His advocate, Saleem Khan, told Durban magistrate Nkosiyazi Ngcobo: “There is no case for him to answer. There is no evidence that he committed the offences.”

Aver is facing charges of culpable homicide, reckless and negligent driving, and failing to stop and/or report the accident.

Jasmin, a University of South Africa student, had left a bar with friends in the early hours of August 12 last year, when she was hit by a car.

The only witness called by the state during the trial, Johannesburg project manager Bayanda Nyaseng, testified that he had seen a silver Nissan 350Z swerve near a group of young women, leaving the body of a young woman lying on the road.

However, he had not actually seen the car hit her, nor had he noted the registration number.

Aver was arrested when, three days later, he went to the office of investigating officer Inspector Rajesh Vishnu with his lawyer and stepfather.

It was put to Vishnu under cross-examination that Aver had simply wanted to “eliminate himself from inquiries”.

Khan said that Nyaseng had only assumed that the car he had seen had hit Jasmin. Vishnu’s evidence had also been contradictory, he said.

The matter was adjourned to give the prosecutor time to prepare his reply.

Aver is out on a warning.
