President Robert Mugabe™s government has once again sought refuge in the same people it despised, maimed, killed and kicked out of Zimbabwe. Zimbabwe™s government is pursuing endless legal challenges trying to legalise the takeover of companies it stole in the name of nationalism . A group of white South African and British lawyers are defending Mugabe™s theft in both British and South African courts.

According to legal documents in possesion of ZimDaily, Brian Cohen Le Roux Inc, a South African based law firm is representing the government of Zimbabwe in the illegal takeover of SMM Holdings PVT Ltd, a company once owned by Mutumwa Mawere.

A coalition of Friends of Zimbabwe, FOZC, have taken it upon themselves to expose the double standards exhibited by these white elements profiteering from Mugabe™s property rights abuses. The chairman of the South Africa based pressure group FOZC, Mr Sox Chikohwero told Zimdaily that proxies like Messrs Frans Odendaal, Christo Bothma and Brink Cohen Leroux are being used to disguise Mugabe™s corruption and abuses of power.

In a petition sent to the Law Society of South Africa, Mr Chikohwero indicated that South Africa appears to recognise Mugabe™s draconian measures that undermine property and human rights. The theft of Mawere™s assets by the government of Zimbabwe if not nipped in a bud could affect investment in Zimbabwe if it hasn™t already he said.

The government of Zimbabwe through a Gwarazimba now running SMM Holdings has been splashing millions fighting losing battles in South Africa and the UK, already Mugabe™s men suffered a big set back in London when a judge spelt out a number of irregularities over non clarification of who is who in the saga in the ongoing case. Zimdaily understands that Gwarazimba is a front for the government of Zimbabwe.

When confronted by FOZC, Brian Cohen Leroux Inc responded with a written statement saying,

In this matter, we act on behalf of SMM Holdings (Private) Limited, a private company incorporated in terms of the Companies Act, Chapter 24/03, of the laws of the Republic of Zimbabwe with its principal place of business at 111 Dagenham Road, Willowvale, Harare, Zimbabwe.

Our sole responsibility is to ensure that the claims of SMM are adjudicated upon according to the laws of the Republic of South Africa. Although we have noted the contents of your letters under reply, we do not intend, in any circumstances, to become involved in politics, whether of Zimbabwe or any other. As far as the representatives of SMM is concerned, everyone has the right to be heard in Court and to have their claims adjudicated upon according to the rule of law. In this regard, you are referred to section 34 of the Constitution of the Republic of South Africa, No. 108 of 1996:

œEveryone has the right to have any dispute that can be resolved by the application of law decided in a fair public hearing before a court or, where appropriate, another independent and impartial tribunal or forum.

With regard to your offer, it is our instructions to decline your offer to settle our client™s claim against SAS in the amount of South African

Rand 81,440.15. This, as you probably know, is not the only claim against SAS. Summons has already been issued for payment against SAS of United States Dollar 13,818,150.27, Canadian Dollar 628,071.84 and South African Rand 4,515,367.48. The validity of these claims will be pronounced upon in due course.

We believe that you have threatened to stage a demonstration at our offices on 3 October 2006. Please be advised that we will not countenance any interference with our staff, clients or business. The premises at which our offices are situated, also house other tenants who, we are sure, will not countenance any interference with their business either. Should you or any of your representatives enter our premises, we shall take such steps as we may deem appropriate.

During the afternoon session of the urgent court proceedings held on 22 September 2006, we placed on record the disconcerting conduct of the lady who took photographs of the legal representatives of SMM. We regard your conduct in this regard as inappropriate, to say the least, and will take such steps as may be required to protect our rights. Suffice it to say, your threats have not escaped our notice and have been duly noted by her ladyship Judge Snyders.

We deny any allegation by yourself of impropriety or wrongdoing on our part and we suggest that you take up this issue, if so advised, in the appropriate forum being the Law Society of the Northern Province and/or the Johannesburg Bar Council.

Mugabe™s has once again extended his hand of corruption and property rights abuses to the money mongers at Brian Cohen Leroux Inc who will do anything for money. When the whole world is uniting condemning the abuses of power by the Mugabe regime, it is very worrying to note that there is still some elements in the white community defending the indefensible. Until these (152)˜unrepentant™ crooks at Brina Cohen Leroux Inc receiving millions of rands from Africa™s brutal regime are dealt with, africa will always be a continent behind.
