JUSTICE Minister, George Kunda, yesterday told Parliament that the death penalty will be maintained on the statute books despite President Mwanawasa not signing any death warrants.
Mr Kunda said the death penalty was “very contentious” and that was why it was among the terms of reference for the Mung’omba Constitution Review Commission (CRC).
He said the majority of the people who submitted before the CRC argued that the death penalty should remain on the statute books.
He was responding to a supplementary question by Mapatizya Member of Parliament Ackson Sejani (UPND) who wanted to know why the death penalty was being maintained when it was not being implemented.
Mr Sejani wanted to know how many people had been sentenced to death from 2001 to date and and how many had been executed.
In an earlier response, Justice Deputy Minister Bradford Machila said 41 people were sentenced to death although none of them was executed.
Katombora MP Regina Msokotwane (UPND) asked whether it was possible for the Government to commute the death sentences to life since those on death row would not be executed.
In response, Mr Kunda said the Prerogative of Mercy committee had commuted a number of death sentences to life and in other cases to tenable terms such as 25 years and 30 years.
Chasefu MP Chifumu Banda (FDD) asked whether the President had the discretion not to follow the law by refusing to sign death warrants. Mr Kunda said he had.
Meanwhile, Speaker of the National Assembly Amusaa Mwanamwambwa has advised the executive to prepare written statements to enable them to debate intelligently in the House because they spoke on policy matters.
Mr Mwanamwambwa was prompted to make the directive after Mbabala MP (UPND) Emmanuel Hachipuka rose on a point of order to ask whether Tourism Deputy Minister Michael Kaingu was order to debate the way he was doing.
In his point-of-order, Mr Hachipuka said, ” Mr Speaker, is it in order for the Deputy Minister not to seek guidance of his Permanent Secretary to prepare a written statement than to start waffling in the House as he is doing?”

At this point, the Speaker advised Mr Kaingu, who appeared to be having difficulties debating, and other members of the executive to always prepare written statements.
In his debate, Mr Kaingu said the tourism sector was booming hence the increase in the number of illegal guesthouses and lodges.
North-Western Province Minister, Kenneth Chipungu, also sent the House into laughter when he said the policies of the New Deal Administration were working hence the increase in “financial blues”.
