Gauteng chef Fanwell Khumalo, allegedly a child serial rapist, took only three hours in the witness box of the Johannesburg High Court on Monday to reply to the 60 court days of evidence the state had presented against him.

Cross examination by the prosecutor, Advocate Marile van Heerden, is expected to take far longer.

Last November, Judge Max Labe, presiding with two assessors, granted Khumalo a discharge on three counts, leaving him facing a total of 129 charges of kidnapping and rape.

The 41-year-old chef has steadfastly maintained his innocence claiming mistaken identity, and saying he was innocent of charges relating to the kidnapping and rape of a number of young girls from the age of seven years up.

DNA testing from Khumalo showed a match in the 21 cases of rape
Khumalo told the court on Monday that he had sex with one of the victims, a 20-year-old woman, because his wife was away on holiday, and that the woman then laid rape charges against him because he had paid her only R25 instead of R40.

Last year, victims from local schools testified they were approached for a directions by a man claiming to be a police officer. They were then taken to a deserted spot and raped. DNA testing from Khumalo showed a match in the 21 cases of rape.

In the witness box, Khumalo once again challenged the legality of the blood sample. He denied that a blood sample used for DNA testing was his.

Cross-examining Khumalo, van Heerden pointed out that medical evidence showed that the only adult victim, who testified that she had been a virgin, had suffered a “substantial tear”.

Van Heerden said that it was improbable that the victim, a “shy, softly spoken person, who was a virgin, would have agreed to sex for money.”

If found guilty Khumalo would have the distinction of being South Africa’s most notorious serial rapist to date in terms of the number of victims.
