PROVOCATION AND INCITEMENT

The security situation on farms and towns is expected to degenerate to such an extent during the festive season that TAU SA is forced to remind it™s members to remain calm and act responsibly.

TAU SA has for some time sent out circulars in this regard. Various developments and previous experience is cause for concern that some organisations and individuals may deliberately provoke farmers or incite action against them. Various forms of provocation has been used against farmers, which has placed the issue of what a reasonable person would do when under threat, under scrutiny.

Farmers are arrested by some ill-wishing SAPS [South African Police Service] members when all they can be charged for, is protection of life and property whilst trying to lead peaceful lives.

When help is offered or trespassers confronted, such action is more than likely to be met by shots out of the dark. The court finding that attacks on farms are not criminally inspired, but rather deliberate murder of property owners and farmers, proves the provocation that usually results in the farmer ending up in the dock.

The political climate prior to the elections and threats by the Landless People™s Movement who do not wish to vote, but rather occupy farms, is a public example of provocation.

The Amendment Bill on Restitution of Land Rights which was approved on 27 November 2003 gives the Minister unrestricted powers to expropriate property without due process in court. This in fact, creates sufficient political motivation to intimidate and provoke farmers.

There is concern that deep-rooted differences within the ANC, the alliance and factions at grassroot level in the preparation for the 2004 elections, may lead to the creation of a œnew right-wing threat which forces government œto protect the democracy. It is expected that in the light of the international ant-terrorism campaign, a œfar-right enemy could be created to facilitate a specific focus during the election campaign.

TAU SA has informed it™s members to be aware of such developments and to act calmly and fairly without capitulating their constitutional rights. TAU SA finds it necessary to warn their members against hidden actions that could be to their own detriment and may lead to possible arrest.

TAU SA distances itself from any form of ill-meaning and wanton attitudes, dispositions, speeches or actions directed against the organisation or it™s members to bring commercial farmers in disrepute with the authorities and South African society at large.
